Terms of service

Last updated 2026-11-04

These terms are an agreement between Hostspica, a sole proprietorship registered in India (GSTIN 09KGCPK3156D1ZE), and the company or organisation that signs up for PunchMe (the "customer", "you"). The person who signs up confirms they are at least 18 and have authority to accept these terms for the customer.

By creating an account or using PunchMe, you agree to these terms, our privacy policy, acceptable use policy, data processing addendum and refund policy.

The service

PunchMe is online software for attendance, leave, field staff, HR and payroll. It includes the dashboard at company.punchme.online, the employee mobile app, office kiosk mode and related APIs. We may improve, change or remove features over time. If we remove a feature you rely on, we will try to give reasonable notice.

Accounts

  • You are responsible for everything done through your account, including by team members and employees you invite.
  • Keep passwords and sign-in codes private. Tell us at security@punchme.online if you think your account has been misused.
  • The account owner controls roles and permissions. Give each person only the access they need.
  • Information you give us, including your company name, address and GSTIN, must be accurate. It appears on your tax invoices.

Free trial

New accounts get a free trial, normally 30 days. No card is needed. We send reminders before the trial ends. When it ends, the account is locked until the wallet has enough balance for the first month. Your data is kept while the account is locked.

Billing

PunchMe uses a prepaid wallet. There is no automatic debit from your card or bank.

  • Top-ups. You add money to the wallet through Razorpay, any amount from ₹1 to ₹10,00,000. Wallet balance does not expire.
  • Monthly charge. At the start of each monthly period, we take that month's charge from the wallet in advance. The charge is the number of active employees at renewal (minimum one) multiplied by your plan rate, plus 18% GST.
  • No proration. Employees added during a month are billed from the next renewal. Employees archived during a month do not reduce the charge for that month.
  • Low balance. If the wallet will not cover the next charge, we tell billing staff by email and in the dashboard during the 3 days before renewal.
  • Insufficient balance. If the wallet cannot cover the charge at renewal, the account is paused. While paused, only billing works and employees see that the account is on hold. Your data is kept. Once you top up enough, the charge is taken and the account resumes automatically.
  • Invoices. We issue a GST tax invoice for each monthly charge, available in the dashboard under Billing. We do not issue invoices for top-ups. CGST and SGST apply if your state is Uttar Pradesh; otherwise IGST applies.
  • Prices. Your plan rate is shown in the dashboard. We may change rates with at least 30 days' notice. A change applies from the next renewal after the notice period.
  • Refunds are covered by our refund policy.

Your responsibilities

You are responsible for how you use PunchMe with your employees. In particular, you must:

  • have a lawful basis under the Digital Personal Data Protection Act, 2023 and other applicable laws for the employee data you put into PunchMe;
  • give employees clear notice of what data is collected and why, before you use PunchMe with them;
  • obtain employee consent where required, especially for face check and field tracking, and respect withdrawal of consent;
  • use location features only for work, only while employees are on duty;
  • comply with labour, employment, tax and data protection laws that apply to you;
  • follow our acceptable use policy.

Your data

You own the data you and your employees put into PunchMe. You give us permission to host, process and transmit it only to provide and support the service, as described in our privacy policy and data processing addendum. We do not sell your data.

You can export data through the reports and CSV exports in the dashboard.

Availability

We work to keep PunchMe available and reliable, but we do not offer a service level agreement or guarantee uninterrupted service. Planned maintenance, outages at our providers, network problems and other events may affect availability. The app can save punches on the phone when there is no network and sync them later, subject to the limits shown in the app.

Beta features and bank files

Some features are marked beta, including RazorpayX salary payouts. Beta features may change, may not work as expected and are provided as they are. Use them with care and check results.

Bank transfer files (such as HDFC ENet and NEFT CSV formats) are generated from common layouts. You must check them against your bank's current template before uploading.

Payroll and statutory calculations

PunchMe calculates salary, PF, ESI, professional tax, labour welfare fund, TDS, gratuity, bonus and related figures, and produces files such as ECR, ESIC, 24Q and Form 16. These are aids to help you prepare your payroll and filings. Laws, rates and formats change, and your situation may differ from the defaults. You are responsible for checking the figures and for all statutory payments, returns and filings. Please confirm with your accountant or tax adviser.

Limitation of liability

To the extent the law allows:

  • PunchMe is provided "as is" and "as available". We do not promise it will be error-free or suit every purpose.
  • We are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill.
  • Our total liability for all claims relating to PunchMe is limited to the amount you paid us for PunchMe in the 12 months before the event that gave rise to the claim.

Nothing in these terms limits liability that cannot be limited under Indian law.

Suspension and termination

  • You can stop using PunchMe at any time by not topping up the wallet. To close your account and have your data deleted, contact support@punchme.online.
  • We may suspend or close an account that breaks these terms or the acceptable use policy, creates a security risk, or where the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem.
  • After closure, you can ask for your data to be deleted. We may keep records we must retain by law, such as invoices.

Governing law and disputes

These terms are governed by the laws of India. The courts at [Ghaziabad, Uttar Pradesh — owner to confirm] have exclusive jurisdiction over any dispute relating to these terms or PunchMe.

Changes to these terms

We may update these terms. We will change the date at the top and tell account holders about significant changes by email or in the dashboard before they take effect. If you keep using PunchMe after a change takes effect, the updated terms apply.
